We at UR Important GmbH ("We") are committed to protecting the privacy of our customers. This Privacy Policy applies to our CRM application ("The App"). This Privacy Policy governs our data collection, processing and usage practices. It also describes our customers’ choices regarding use, access and correction of their personal information. By using the App our customers consent to the data practices described in this Privacy Policy. If anybody does not agree with the data practices described in this Privacy Policy, he or she should not use the App.

1. Important Information

1.1. Changes to this Privacy Policy

We may update this Privacy Policy from time to time by posting a new version online. Customers should check this page occasionally to review any changes. The continued use of the App and/or continued provision of Personal Information to us will be subject to the terms of the then-current Privacy Policy.

1.3. Security

We use a variety of security technologies such as payload encryption in addition to secure transmission over SSL and procedures to help protect your Personal Information and Business Data from unauthorised access, use or disclosure. We use carefully selected service providers that host our systems in a controlled and secure environment.

2. Data Types

From here on we will also need to distinguish our responsibilities regarding the Personal Information of our customers (section 3) and our customers’ responsibilities regarding the Personal Information of their customers (section 4).

But let us distinguish Personal Information from Data Categories and Business Data first.

2.1. Our customers’ Contact Information / Personal Information

Personal Information or Contact Information refers to any information that customers voluntarily submit to us and that identifies them personally, including contact information, such as name, e-mail address, company name, address, phone number, and other information about them or their business.

In order to provide the service we ask customers to create an enterprise profile as well as individual user profiles for each staff member that uses the App. These profiles provide relevant contact information as well as the means of identifying an individual user as member of a given company. This data is considered Personal Information.

2.1.1. Reviewing, Correcting and Removing Your Personal Information

Our customers can view and correct their Personal Information through the Company Management and User Management in the app. Admin-level users of the app can delete the individual member-level user accounts. The main contact person of our customer can also request that their user information should be deleted from our records - however, by cascade this requires us to also terminate their contract with us which means that eventually active subscriptions will be forfeited and that their business data will need to be deleted. In order to do so we ask our customers to please send us their termination and deletion request by e-mail using the e-mail account with which they registered the company and that they include a copy of their ID card, passport or equivalent proof of identity so that we can safely take into account their request. We may also contact you by phone or request a video call as additional proof of identity to make double sure that nobody impersonates one of our customers so as to make sure that no data will be lost by malicious intentions.

2.2. Our customers’ Data Categories

Our App allows our customers to configure data categories which enable them to store any kind of data which they deem relevant for managing their relation with their customers on our servers. These Data Categories do not represent any Personal Information.

2.3. Our customers’ Business Data

Our customers will also enter and maintain information in the customer records, appointments and their associated data categories. This information is stored and managed on our service providers' servers and is only accessible through the App. This information might very well contain personal information, but this information is not requested, used, managed or maintained by us and is therefore not considered as personal information in the scope of our relationship with our customers and users of the application.

2.4. Sensitive Information

This refers to credit or debit card numbers, personal financial account information, Social Security numbers, passport numbers, driver's license numbers or similar personal identifiers, racial or ethnic origin, physical or mental health condition or information, or other employment, financial or health information.

2.5. Information About Children

The App is not intended for or targeted at children under 13, and we do not knowingly or intentionally collect information about children under 13. If you believe that we have collected information about a child under 13, please contact us at contact@ur-important.com, so that we may delete the information. If you believe that any of our customers has collected such information please contact them directly so that they can take appropriate action.

2.6. Usage Information

In future versions we may use mobile analytics software to allow us to better understand the functionality of our Mobile Apps on your mobile device. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from.

3. Our Use of the Data

We do not share ANY Personal Information or Business Data with ANY third party. We use the information we collect only in compliance with this Privacy Policy. Customers who subscribe to our Subscription Services are obligated through our agreements with them to comply with this Privacy Policy. We will never sell our customers’ Personal Information or Business Data to any third party.

3.1. Personal Information / Contact Information

We reserve the right to use the contact information customers provide us with in their enterprise profile in order to reach out to them for example for important communications. We may transfer your Personal Information, but not your customers' Personal Information which you created as Business Data, to carefully selected companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our customers. We retain Personal Information that customers provide us as long as we consider it potentially useful in contacting you about the Subscription Service or our other services, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements, and then we securely delete the information. To facilitate our global operations, we may transfer and access Personal Information from around the world, including the United States. This Privacy Policy shall apply even if we transfer Personal Information to other countries.

3.2. Data Categories and Usage Information

We also reserve the right to analyse anonymously the data categories which are created by all app users as well as anonymous usage information in order to make product improvements which will help the app users customise the app more easily in future versions.

3.3. Business Data

We do not use or analyse ANY of our customers’ Business Data which they store in customer records, appointments including their data categories for ANY purpose.

5. Our Customers’ Business Data

Our customers use the App for organising and storing data. We do not control the content or the types of information that customers may choose to collect or manage using the App. That information belongs to them and is used, disclosed and protected by them according to their privacy policies and is not subject to this Privacy Policy. We process our customers' data as they direct and in accordance with our agreements with them, and we store it on our service providers' servers, but we do not have control over its collection or management. Our agreements with our customers prohibit us from using that information, except as necessary to provide and improve the App, as permitted by this Privacy Policy, and as required by law. We have no direct relationship with individuals who provide Personal Information to our customers. We are not responsible for the use of information which our customers collect with the App. The App collects information under their direction and we have no direct relationship with the individuals whose Personal Information the App processes.

5.1 Obligations of our customers

Our customers control and are responsible for correcting, deleting or updating information they have collected. Our agreements with our customers prohibit them from using the App to collect, manage, or process Sensitive Information, Information About Children or to use the App for any activities which are against applicable law. They must follow applicable local data privacy laws which may oblige them to show the data they collected for one of their specific customer to this customer so that data can be modified or deleted. Our customers must be available as contact persons to their customers if questions on privacy arise. If our customers’ customers request not to be contacted by our customers anymore, then our customers must take appropriate action such as removing their customer from mailing lists or by taking note that unsolicited e-mails must not be send and/or that phone calls must not be made to the concerned customer.

5.2 Rights of our customers' customers

We acknowledge that our customers’ customers have the right to access their Personal Information. If you are a customer of one of our customers and would no longer like to be contacted by one of our customers that use our App, please contact the customer that you interact with directly. If you provide information to our customers as part of their use of the Subscription Service, our customers decide how long to retain the personal information they collect from you, however, you are entitled to contact them and request that this information will be shown to you, corrected or deleted. If a customer terminates its use of the Subscription Service, then we will still provide our customers with access to all information stored for their customers by the Subscription Service, including any Personal Information provided by you. After termination of our contractual relationship with our customer, we may, unless legally prohibited, delete all customer information, including your Personal Information, after a reasonable delay.

5.2.1. To Unsubscribe from Our Customers' Communications

Our customers are solely responsible for their own marketing emails and other communications; we cannot unsubscribe you from their communications. You can unsubscribe from our customers' marketing communications by contacting them directly.

6. Additional Terms

6.1. Corporate Events

If we (or our assets) are acquired by another company, whether by merger, acquisition, bankruptcy or otherwise, that company would receive all information gathered by UR Important through the Subscription Service. In this event, you will be notified via email and/or a prominent notice on our website, of any change in ownership, use of your Personal Information, and choices you may have regarding your Personal Information.

6.2. Compelled Disclosure

We reserve the right to use or disclose your Personal Information if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.
